These Terms of Use (“Terms”) govern your access to and use of the Monky mobile application (“Monky”, “the app”). By using Monky, you agree to these Terms.
You must be at least 18 years old and able to enter a binding agreement in your jurisdiction, and you must comply with applicable app store rules. Monky is not intended for anyone under 18.
We grant you a limited, non-exclusive, non-transferable license to use Monky for personal, non-commercial purposes, subject to these Terms and store policies.
Monky provides general wellness-style content and tools. It is not medical, psychological, or legal advice. Do not use Monky as a substitute for professional care. If you are in crisis, contact emergency services or a qualified professional.
You are responsible for activity on your account and for keeping your sign-in methods secure. We may suspend access for violations of these Terms or applicable law. You can permanently delete your account and associated data at any time from Settings → Delete account. Cancel auto-renewing billing in Apple/Google subscription settings (Manage subscription in the app); deleting Monky data does not by itself stop store billing.
Certain features require a paid subscription (“Monky Pro”). Plans are offered as weekly and yearly options, as shown in the app with localized prices from the store.
You agree not to misuse Monky, reverse engineer the app except where permitted by law, or attempt to access systems without authorization.
Monky, its branding, and content are owned by us or our licensors. You may not copy or redistribute them except as allowed by these Terms.
Monky is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
To the maximum extent permitted by law, we and our officers, directors, employees, and partners are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of Monky or these Terms, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to Monky or these Terms will not exceed the greater of (a) the amounts you paid us for Monky Pro in the twelve (12) months before the claim or (b) USD $50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any mandatory consumer rights that apply in your country of residence (for example in the EU/UK).
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Monky and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of Monky, your violation of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of Belgium, excluding conflict-of-laws rules that would require another law, except where mandatory consumer protection laws of your country of residence require otherwise. Subject to those mandatory protections, the courts of Belgium (and, where applicable, the courts of the judicial district of Brussels) have jurisdiction over disputes arising from these Terms or Monky, unless applicable law gives you the right to bring proceedings in your local courts.
If you are a consumer in the European Economic Area, United Kingdom, or another jurisdiction with non-waivable consumer protections, nothing in this section deprives you of those protections or of access to courts in your place of residence when the law requires it.
We may update Monky or these Terms. Continued use after changes constitutes acceptance of the updated Terms where permitted by law.
